September 27, 2018 meeting of the Gardiner Zoning Board (held at the firehouse in the hamlet of Gardiner).
 
ZBA members present:
David Gandin
Joe Katz
David Sterman
 
meeting called to order at 7:14 PM.
 
1. ZBA met with Anthony Brown of 168 McKinstry Road regarding the construction of an accessory apartment on on the property. The requested variances involved both a setback that is short of the required 30 feet minimum, as well as a variance request to build a second structure on the lot, when the lot size does not exceed 2 acres. There had been some question regarding whether it was a 2 or 5 acre minimum lot for a non-conforming structure, and Mr. Brown was able to produce documentation from the Gardiner website confirming that the minimum lot size was to be 2 acres. The property on 168 McKinstry is just shy of 2 acres. The ZBA members reviewed the five guiding principles to issue a determination, and concluded that the variance regarding the setback is approved, as is the construction of the second structure on the property. 
 
2. The ZBA had been scheduled to hear from Lazy River regarding variance requests but that party was not in attendance.
 
3. Though the ZBA had not been notified, representatives of Peak Ranch Inn, a lodging and restaurant proposed for a lot that sits by Route 299 and Yankee Folly Road, came to discuss a variance request. Due to a lack of information, the ZBA members felt they could not proceed with the application until the next ZBA meeting. Prior to that meeting, the ZBA aims to visually inspect the property.

CALL TO ORDER

1.  APPEAL TO THE TOWN OF GARDINER ZONING BOARD OF APPEALS

Pursuant to Section 220-59L of the Gardiner Town Code, and Section 267-a[6] of New York Town Law, Hilary Adler and Bruce Chapman hereby appeal to the Zoning Board of Appeals the determination of the Town of Gardiner Building Inspector that the proposed Heartwood Lodging Facility is classified as a "lodging Facility" under the Town of Gardiner Zoning Code. Property is situated on Route 44/55, directly adjacent to the Tuthilltown Distillery. Zoned RA (Rural Agricultural) Section Block Lot # 93.491.1-42.100 & 42.120.
